GENERAL TERMS JEZRA TRAVEL
Article 1. Applicability
1. These general conditions of service
provision shall apply to the undertaking
between Jezra Travel based in Wadi Musa,
Jordan and the client(s).
Article 2. Performance
The extent and nature of the services to be
carried out by Jezra Travel shall be
established exclusively in the offer
provided in writing by the organiser and
accepted by the client. Possible changes
shall require the express written permission
of Jezra Travel. Obvious errors and
omissions in the offer shall not be binding
on Jezra Travel.
Jezra Travel shall accept no liability for
photos, folders and other informative
materials published under the responsibility
of third parties.
Article 3. Conclusion of contract
1. The contract shall be concluded on the
client’s acceptance of the offer of Jezra
Travel.
2. Jezra Travel’s offer is free from
obligation and may be rescinded if need be.
Rescission must take place as quickly as
possible but must occur within 2 working
days of acceptance by the client.
3. At the conclusion of the contract, or as
quickly as possible following this, the
client shall provide all information
regarding himself and other participant(s)
which are deemed necessary to the correct
execution of the agreed services.
4. The client shall be liable for all
commitments arising from the contract
regarding himself and other participant(s).
Article 4. Price
1. Calculated on the basis of the programme
proposal agreed in the offer, the price
shall be per person in Euros, unless
expressly agreed otherwise. Services which
are added or changed at a later date must be
confirmed by Jezra Travel in writing and
shall be considered as accepted in the
absence of word to the contrary from the
client.
2. The price shall be based on the prices,
rates of exchange and taxes as they were
known to Jezra Travel at the time of
bringing out the offer.
3. Jezra Travel shall be entitled to
increase the price up to 20 days before the
beginning of the tour, to cover changes in
the costs of transportation (including fuel
costs), taxes payable and the applicable
rates of exchange. With respect to this,
Jezra Travel shall indicate how the
surcharge has been calculated. If there
should be a surcharge of 15% or more, the
client shall be entitled to rescind the
contract and shall be entitled to a refund
of monies paid in advance. This entitlement
shall expire 48 hours after receipt of
notification. The client shall have no right
to claim for damages.
Article 5. Payment schedule
1. In order to safeguard the services of
contracted service providers such as
carriers or accommodation providers, Jezra
Travel must engage these in time and must
moreover subject himself to their payment
and cancellation conditions. For this
reason, the following payment period shall
apply:
a. 25% of the total sum stated in the offer
must be paid immediately on acceptance;
b. 100% of the total sum must be paid no
less than 4 weeks before the departure date;
2. Payment must be made according to the
method and in the currency stated in the
offer.
3. In the case of failure to pay on time,
Jezra Travel may rescind the contract
following a notice to pay. In this case,
monies already paid shall not be refunded
and the stipulations of article 7 of the
contract shall apply.
Article 6. Alterations by the client
1. Alterations to parts of the tour or the
programme, at the request of the client,
shall be carried out by Jezra Travel as far
as possible. Possible extra costs charged by
the contracted service providers over and
above the organisation costs stated in the
offer, shall be charged on.
2. A reduction in the number of participants
in the tour or the programme will be
considered as a (partial) cancellation and
article 7 paragraph 2 shall apply.
Article
7. Cancellation
Unless agreed otherwise in writing, the
following stipulations shall apply in the
case of cancellation by the client:
1. Should the client cancel the contract,
the following sums shall be immediately paid
to Jezra Travel:
a. in the case of cancellation up to 30 days
before departure: 25% of the total sum
b. in the case of cancellation from 29 up to
14 days before departure: 50 % of the total
sum
c. in the case of cancellation from 13 up to
2 days before departure: 75 % of the total
sum
d. in the case of cancellation from 2 days
including the day of arrival or no show: 100
% of the total sum
2. Should the client cancel the contract
with regard to one or more participants, the
percentages stated above shall apply,
multiplied by the tour costs per person and
then multiplied by the number of cancelled
participants.
Article 8. Insurance
The client shall be responsible for
arranging travel insurance.
Article 9.
Documents/visas/inoculations
1. By the finalising of the contract at the
latest, general information regarding
passports and visas will be provided to the
client by Jezra Travel.
2. The client must ensure that, on departure
and during the tour, he is in possession of
the necessary travel documents such as
passports, visas, etc.
3. Should a client be unable to undertake or
complete the tour owing to the absence of
one of the documents intended above, the
costs arising shall be chargeable to him.
4. After the development of the agreement
the client shall procure the necessary
supplementary information from the
authorities concerned and also ensure that
information previously obtained has not been
changed during the period before departure.
Article 10.
Cancellation/changes owing to significant
circumstances on the part of Jezra Travel
1. Should the tour be unable to proceed
owing to significant circumstances over
which Jezra Travel has no control, Jezra
Travel shall be obliged to make these known
to the client immediately. Once this has
been made known the contract shall be
considered rescinded.
2. Should the tour have to be altered owing
to significant circumstances over which
Jezra Travel has no control, Jezra Travel
shall be obliged to make this known to the
client immediately with a simultaneous
statement of possible extra costs. If the
client cannot be reasonably expected to
proceed with the tour, he shall then be
entitled to rescind the contract. This
entitlement shall expire 48 following
receipt of notification.
3. Should this contract be rescinded in
accordance with the above, Jezra Travel
shall be obliged to refund immediately all
monies already paid by the client that are
in her possession. She shall also undertake
to claim back sums of money already paid to
third parties and, where possible, to hold
any third parties liable for the damages
incurred by the client and herself. However,
Jezra Travel cannot be held responsible for
more than that with regard to the client,
except in the case of deliberate intention
or gross negligence. In such a case, she
must refund all monies paid in advance.
Article 11.
Organiser’s liability
1. Should the tour of the event not be
carried out according to plan and in
accordance with other agreements made, Jezra
Travel shall be responsible to the client
for any damages arising from this unless the
shortcoming cannot be ascribed to her or to
the person whose assistance she has enlisted
for executing the contract, because:
a. the shortcoming in executing the contract
can be ascribed to the client; or
b. the shortcoming in executing the contract
could not be foreseen or could not be
rectified and can be ascribed to a third
party not involved in the delivery of the
services included in the tour or the event;
or
c. the shortcoming in executing the contract
can be ascribed to an event which Jezra
Travel, or the person(s) whose assistance
she has enlisted to execute the contract, in
spite of all due care and attention, could
not foresee or remedy; or
d. the shortcoming in executing the contract
can not be ascribed to him as a result of
force majeur as intended in article 12.
Article 12.
Force majeur
Force majeur shall be understood to be
abnormal and unforeseeable circumstances
which are beyond the will and control of
those to whom they refer and the
consequences of which cannot be avoided in
spite of all precautionary measures.
Article 13.
Exclusions and limitations of Jezra Travel’s
liability on the grounds of contract
1. Jezra Travel will accept no liability for
damages which are covered by the usual
medical, accident, travel and/or
cancellation insurance policies.
Article 14.
Obligations of the participant
1. The participant(s) shall be obliged to
observe all instructions from Jezra Travel
which are in the interests of the
satisfactory execution of the tour and shall
be liable for any damages caused through his
(their) improper behaviour. 2. A participant
who occasions, or may occasion, such
nuisance or inconvenience as to strongly
impede or threaten to impede the
satisfactory execution of the tour, may be
excluded from (further) participation in the
tour if it cannot reasonably be required of
this person that the contract will be
observed. All costs arising from this shall
be chargeable to the client.
Article 15.
Complaints procedure
1. Any shortcoming established in the
execution of the contract must be
communicated as quickly as possible to the
service provider concerned so that he/she
may find a suitable solution. Should the
shortcoming not be rectified within a
reasonable period of time and prejudices the
quality of the tour, this must be
communicated immediately to a representative
of Jezra Travel. Should this person not be
available or reachable, the participant must
contact Jezra Travel immediately.
2. Should a complaint not be rectified
satisfactorily, this must be made known to
Jezra Travel within 72 hours following
return.
